I am a tenant in Dubai and my contract expired on the end of August 2021. I evicted the Apartment and handover the keys to the landlord on time. Even though the landlord refused to return for me the 2000 AED Security deposit, and moreover he is requesting me to pay 1000 AED extra for maintenance required.
Does he have the right to do such? And can he open a case on me?
Answer: It is important that you go back to the Tenancy Contract and check the points agreed between you, look for the points related to expiry of the contract and vacating, and what exactly it is stating.
In most of the cases the contract contains point that the property should be returned to the landlord with the same condition it was handed over, so maybe the property currently need maintenance, repainting, decor arrangements and that’s why landlord maybe asking for the 1000 AED extra.
Personally I don’t think that the landlord will open a case for such point, but he want to return the property to it’s original condition when handed over. To have a friendly agreement is the best solution.
